The Disrespect for Marriage Act – Republicans Again Fall for Democrat Deception

Conservatives suffered a major defeat in the House of Representatives on July 19, by Democrats and Republicans who seek to destroy traditional marriage and the values of American freedom – permanently. They intend to force the deceptively named “Respect for Marriage Act” (RFMA) on all the states before the 2022 midterms.

The RFMA (H.R. 8404) was introduced a mere three days before it was passed in the House. It is essentially a subversive plan to destroy marriage and to expand federal power over the states.

Following a dereliction of GOP leadership, 47 of 211 House Republicans joined all House Democrats to pass the radical bill that will make the redefinition of marriage virtually impossible to reverse. The RFMA passed by a vote of 267-157, all 220 Democrats and 47 Republicans voting for the legislation, according to the House Clerk. Of the lawmakers who declined to vote, all seven were Republicans. (Not whipping votes against Democrat base-pandering and LGBT cultural transformation, Republican House Minority Leader Kevin McCarthy and Republican Minority Whip Steve Scalise gave their members permission to support the RFMA.)

Instead of standing for natural marriage, the 47 Republicans voted for same-sex “marriage.” As LifeSiteNews described it, “a direct affront to respect for the union of one man and one woman as designed by God – betraying state sovereignty under the Constitution by adding more power to an increasingly centralized federal government.”

CNBC admitted that passage of this bill is a “direct reaction to the Supreme Court’s ruling striking down Roe v. Wade.” The network said, “It would also fully repeal the Defense of Marriage Act, known as DOMA, the 1996 law signed by then-President Bill Clinton that defined marriage as being the union of a man and a woman.” The legislation actually states that its purpose is to “repeal the Defense of Marriage Act and ensure respect for State regulation of marriage, and for other purposes.” Of course, that second part is false; the last thing it will do is respect states’ rights on marriage. H.R. 8404, the RFMA, will essentially give federal protection to same-sex “marriage.” That can have serious consequences for religious liberty and free speech.

As the American Family Association explained it, the law would create a “private right of action” that radical activists can use to sue anyone who blocks their path. In addition, the RFMA authorizes the DOJ to go after violators. “This will include a wide array of Christian nonprofits, starting with adoption agencies and foster-care providers and other groups that work with federal and state governments. The ultimate aim of the bill is to eliminate any chance of there being a legal challenge to Obergefell. State legislatures will be intimidated into doing nothing, as the supporters of traditional marriage are silenced and canceled.

“Worse still, the Respect for Marriage Act could be used by the IRS… to force K-12 religious schools to hire same-sex married teachers. It could be used to try to require Christian universities to enroll same-sex married students. It could even be used to destroy the nonprofit status of pro-family groups.”

The RFMA is a threat to real constitutional rights – to free speech, freedom of religion, and freedom of assembly. The legislation could be viewed as a license for the IRS to revoke the tax status of Christian schools, universities and nonprofits, with the same intensity as it harassed and intimidated conservative Tea Party organizations and traditional marriage groups from 2009/2010 onward, and blatantly delayed or refused applications for charitable tax status.

The RFMA is now in the U.S. Senate. Don’t expect any committee hearings; the bill could come to the floor at any time. Democrats consider it a priority, and Majority Leader Senator Chuck Schumer will be willing to trade almost anything to get moderate Republicans on board. They need 60 votes to avoid a filibuster, which means they need 10 Republicans to support their radical “marriage” agenda.

As Justice Clarence Thomas observed in his concurrence in the Dobbs case, “[I]n future cases, we should reconsider all of this Court’s substantive due process precedents, including Griswold, Lawrence, and Obergefell.” Obergefell was the decision that created a “constitutional right” to same-sex “marriage” out of thin air, nullifying the ability of states to define marriage according to the historical and natural definition of one man/one woman. The RFMA intends to protect the Obergefell decision.

Republican Senators must not be deceived by this push-back to the Roe reversal, to advance the LGBT agenda and codify same sex “marriage” federally, overriding state laws.

The RFMA must not succeed in the Senate.
